Throughout the website and this document the terms “we”, “us”, and “our” refer to www.jamesburleigh.co.uk
The following Terms & Conditions apply to orders from our Retail Shop Website only and by visiting and/or purchasing something from our Retail Shop Website, you agree to be bound by these Terms and Conditions, including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms and Conditions apply to all users of our Retail Shop Website, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

Our Retail Shop Website is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products to you.
1. How to Order
Orders can be placed directly through our Retail Shop Website, via email to email@example.com or over the phone on 020 8965 3966. After an order is received we will forward an email confirming receipt within 24 hours or by the next working day. If you do not receive this confirmation email please contact us to confirm that your order has been received by us and is being dealt with.
Once the order has been received and accepted (by means of the confirmation email) a purchase contract exists between us.
Please only place your order if you are completely sure that the item and its finishes are right for your needs as you will not be able to change the order after we enter production or because it is different to what you expected - unless of course we have not supplied the correct item or specification as per the order confirmation.
The price payable for the products are as listed on the Retail Shop Website and are inclusive of VAT.
Prices are subject to change without notice. We reserve the right to modify or discontinue any product from our product range without notice at any time.
3. Personal Information
You agree to provide current, complete and accurate purchase and account information for all purchases made from our Retail Shop Website. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.
4. Cancellation by You
Please note you may cancel your purchase contract with us up to 7 days from the date you placed your order.
5. Cancellation by Us
We reserve the right to cancel any order at any time. Cancellation may be as a result of:
- The product being no longer available
- We cannot arrange delivery to your area
- We are unable to get authorisation for your payment
- There has been a pricing or product description error/omission
- We cannot fulfil the contract due to stock colours not being available
We will of course contact you should a cancellation be necessary and any money paid by you will be refunded by the method you used to pay us as soon as possible but in any event within 30 days. We do not offer compensation for disappointment or inconvenience caused.
6. Description and Product Information
Every effort has been made to ensure colours and finishes appear as realistically as possible. However, we cannot guarantee that the colour you see on your screen will be the exact colour of the product in real life. Samples including colours and wood finish swatch are available on request.
Every care is taken to ensure descriptions and measurements are accurate, however minor variations may occur.
7. Lead Times
Please note delivery dates are non-binding estimates only, based upon the best available information concerning lead times and transportation schedules. You will be deemed to have accepted the estimated delivery date/s unless you notify us that these are not acceptable to you within 7 days of the order being placed. Any special delivery requirements should be specified at the time the order is placed for us to consider. Additional charges may be levied accordingly.
It is essential that you check that the access into your property is suitable for delivery of the order as we deliver on the basis that you’ve checked all the dimensions and space to manoeuvre the item you’ve ordered and that it will fit through all doorways, stairwells, lifts, passageways and within the area of intended use where you will be placing it. It is your responsibility to attend to this stipulation prior to placing an order. We are not able to accept cancellations on the grounds of access after a purchase contract has been entered into.
- We will deliver your order to the delivery address specified at the time you placed your order. Changes to the delivery address can be accepted in some cases but may incur additional charges and/or delay delivery.
- We will notify you by email or phone prior to despatch.
- You will become the owner of the goods you have ordered when they have been delivered to the address specified by you and full payment has been received by us.
- Self assembly may be required.
- Delivery is free for UK mainland. For other destinations please email us.
- We cannot accept responsibility for goods that are undeliverable due to:
- insufficient access for any reason
- your absence at the arranged time of delivery in which case you agree to pay any additional storage or delivery costs incurred
- All furniture is quality checked before being packaged and delivered to you in robust packaging that is fully recyclable.
- You are responsible for inspecting the goods upon delivery.
- Any damage or faults must be reported to us without delay and certainly within 48 hours of receipt.
- Once goods have been delivered and signed for, you are liable for any subsequent damage or loss.
10. Returns & Refunds
Please note that all our products are made to order or customised as per your choice of colour and finish and are not eligible for refunds, unless proven to be faulty in which case a replacement will be manufactured and delivered as soon as possible.
We take all reasonable precautions to keep the details of your order and payment secure but, in the absence of negligence on our part, we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to our Website and illegally steals and makes use of your personal data.
You agree to indemnify, defend and hold harmless James Burleigh Ltd and our employees and directors from any claim or demand, including reasonable legal fees, made by any third-party due to or arising out of your breach of these Terms & Conditions or the documents they incorporate.
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms & Conditions, such determination shall not affect the validity and enforceability of any other remaining provisions.
